Terms of Service

This document is a computer-generated electronic record published in terms of Rule 3 of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (as amended) read with the Information Technology Act, 2000 (as amended), and does not require any physical or digital signatures.

1. Parties & entity disclosure

These Terms of Service ("Terms") constitute a legal agreement between you ("You", "Your", "Yourself", "Buyer") and Bani Thani ("Bani", "we", "us", or "our"), a sole proprietorship owned and represented by Harshita Goyal, with its principal place of business at GF-1, Gopal Tower, Shri Ram Colony, Gwalior, Madhya Pradesh – 474002, India.

GSTIN: 23AMMPG9088N1ZB. Contact: support@glitchexecutor.com. These Terms govern Your access to and use of the website grow.glitchexecutor.com on the /in/ variant ("Platform") and the digital products and related services made available through it ("Services"). The Services are intended for use in India.

2. Acceptance & eligibility

By submitting a lead-capture form, downloading the free Vibe Coder Kit, completing a checkout transaction for any paid agent agent, or otherwise accessing the Platform, You confirm that You have read, understood and accepted these Terms. If You do not agree, do not use the Service.

You may register or transact only if You are at least 18 years of age and competent to enter into a binding contract under the Indian Contract Act, 1872. You are responsible for the secrecy of any login or order-confirmation credentials and for all activities carried out under Your account or transaction reference.

3. The Services

• Free Vibe Coder Kit — a Claude Code / Codex / OpenClaws configuration package provided at no cost in exchange for the contact information You submit through the lead form.
• Paid AI agents — source-available repositories You may purchase à la carte or as part of the AI Digital Marketing Stack bundle. Each purchase is a one-time transaction granting You a perpetual licence under the Business Source License 1.1 (BSL 1.1) for the purchased agent, with the rights and restrictions stated in the licence file inside each repository.
• The Services are digital products delivered electronically (download links, repository access, community-channel invites). They are not subject to physical shipping.

4. Pricing, payment & Razorpay

• All prices on the India variant are listed in Indian Rupees (INR) and are inclusive of any indirect taxes payable in India by the seller, unless explicitly stated otherwise.
• Payment is processed by Razorpay Software Private Limited ("Razorpay") as a payment aggregator licensed by the Reserve Bank of India under the Payment and Settlement Systems Act, 2007 and the RBI Guidelines on Regulation of Payment Aggregators and Payment Gateways. By initiating a payment You also accept Razorpay's own terms of use and privacy policy.
• Bani Thani does not store Your card, UPI VPA or net-banking credentials. Such instrument data is collected and tokenised by Razorpay in compliance with the RBI's card-tokenisation framework.
• Where applicable, GST under GSTIN 23AMMPG9088N1ZB is collected and remitted by Bani Thani per the Central Goods and Services Tax Act, 2017.
• Razorpay may, at its sole discretion and in compliance with applicable RBI Card Payment Network Rules, decline, hold or reverse a transaction. Any such action by Razorpay is outside Bani Thani's control.

5. Refund & cancellation

• Free Vibe Coder Kit — no payment, no refund. You may unsubscribe from associated communications at any time.
• Individual paid AI agents (BSK-001 to BSK-006) — eligible for a full refund within 14 days of purchase, requested by replying to Your Razorpay receipt or emailing support@glitchexecutor.com. After 14 days no refunds are issued, in line with the digital-goods nature of the Service.
• AI Digital Marketing Stack bundle (BSK-ALL) — eligible for a full refund within 7 days of purchase via the same channel. The shorter window reflects the bundle's substantially higher value and the corresponding asymmetry in risk where source code is delivered immediately on purchase. After 7 days the bundle is non-refundable.
• On any refund, Your access to the private repository, Discord paid channels, and lifetime-update entitlement is revoked, and Your licence under Section 6 terminates with effect from the refund date.
• Approved refunds are processed back to the original payment instrument via Razorpay, typically within 5–7 working days from confirmation, subject to issuing-bank settlement timelines.
• For payment disputes (chargebacks, fraudulent debit allegations), You may reach Razorpay's grievance redressal channel at razorpay.com/grievances in addition to contacting us directly.

6. Licence & intellectual property

Source code purchased through the Service is licensed under Business Source License 1.1. Headline terms:

• You may modify, deploy, and deliver derivatives of the licensed agent to Your own end clients (this is the "Permitted Use" we explicitly grant).
• You may NOT repackage and resell the agent or the Stack itself as a competing developer-tool kit.
• Four years after each version's release date, that version automatically converts to the Apache 2.0 licence.
• The full licence text accompanies each repository.

All trademarks, trade names, service marks, logos, brand features and the underlying website design of grow.glitchexecutor.com remain the sole property of Bani Thani. You acquire no right, title or interest in such marks by virtue of these Terms or any purchase.

7. Buyer obligations

• You are responsible for the lawful operation of any derivative service You build using the agents, including obtaining Your own API keys, ad-account access, and any sector-specific licences (for example, financial advisory, healthcare).
• You shall not use the Service to send spam, run unlawful ad campaigns, scrape data in violation of platform terms, or otherwise contravene applicable Indian or foreign law.
• You shall not post or transmit through the Platform any material that is unlawful, threatening, defamatory, obscene, infringing, virus-bearing, or that threatens the unity, integrity, defence, security or sovereignty of India, in line with Rule 3(1)(b) of the IT Rules, 2021.
• You shall provide true, accurate and current information when prompted by the Platform, and update it when it changes. Inaccurate information may result in suspension of access or refusal of refunds.
• Where required by Razorpay or by law-enforcement / regulatory authorities, You shall cooperate with KYC or transaction-related queries and provide such documents as Razorpay may request.

8. Disclaimer of warranties

The Service is provided "as is" and "as available". Bani Thani makes no warranty, express or implied, that the agents are error-free, fit for any particular purpose, capable of producing any specific business outcome, or compatible with any particular third-party API or platform. Numbers, screenshots, and case studies on the marketing pages are illustrative and do not constitute a guarantee of results.

9. Limitation of liability

To the maximum extent permitted by Indian law, Bani Thani's total aggregate liability arising out of or relating to the Service shall not exceed the amount You paid for the specific agent or bundle giving rise to the claim. Bani Thani shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if advised of the possibility of such damages.

10. Indemnity

You agree to indemnify, defend and hold harmless Bani Thani, its proprietor, employees, agents and contractors from and against any claim, demand, loss, liability or expense (including reasonable legal fees) arising out of or relating to (i) Your breach of these Terms, (ii) Your misuse of the Services or any derivative service You build using the agents, or (iii) Your violation of any law or third-party right.

11. Force majeure

Bani Thani shall not be liable for any failure or delay in performance under these Terms to the extent such failure or delay is caused by acts of God, natural disaster, war, terrorism, riot, civil disturbance, pandemic, government action, network or infrastructure outage, or any other event beyond its reasonable control.

12. Anti-bribery, sanctions & export controls

You represent and warrant that You will comply with all applicable anti-bribery laws (including the Prevention of Corruption Act, 1988) and that You are not subject to any trade sanctions or export-control restriction imposed by India, the United Nations, or any jurisdiction whose laws apply to Your use of the Services. You shall not use the Services in any manner that would cause Bani Thani to violate such laws.

13. Privacy

Personal information collected through the lead-capture form and purchase flow is processed in accordance with our India Privacy Policy, which describes the data we collect, the purposes of processing, Your rights under the Digital Personal Data Protection Act, 2023 ("DPDPA") and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and how to exercise those rights.

14. Suspension & termination

Bani Thani may suspend or terminate Your access to the Service for material breach of these Terms, suspected fraud, or on instructions from a competent authority, with reasonable notice unless the breach is egregious. Sections 5 to 12, 14, and 16 survive termination.

15. Assignment, waiver & severability

You may not assign or transfer Your rights or obligations under these Terms without our prior written consent. Bani Thani may assign these Terms in whole or in part without notice. Failure to enforce any provision is not a waiver of the right to enforce it later. If any provision is held unenforceable, the remaining provisions remain in full force.

16. Governing law & dispute resolution

These Terms are governed by and construed in accordance with the laws of Madhya Pradesh, India. Any dispute arising out of or relating to the Service shall be finally settled by arbitration seated at Gwalior, Madhya Pradesh, in English, by a sole arbitrator appointed under the Arbitration and Conciliation Act, 1996 (India). The courts at Gwalior, Madhya Pradesh shall have exclusive jurisdiction over any matter not subject to arbitration.

17. Changes to these Terms

Bani Thani may update these Terms from time to time. The current version will always be available at this URL with the "Last updated" date. Material changes will be notified by email to active users. Continued use of the Service after the effective date of any change constitutes acceptance.

We acknowledge such requests within 7 working days and respond within 30 days, in line with the IT Rules, 2021 and the DPDPA. For payment-instrument disputes, You may also approach Razorpay at razorpay.com/grievances.
